Welcome to EnglishMY, Malaysia's premier English language learning institution. These Terms of Service ("Terms") govern your use of our website, services, and educational programs. By enrolling in our courses or using our services, you agree to be bound by these terms.

1. Acceptance of Terms
By accessing and using EnglishMY's services, enrolling in our courses, or using our website, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our services.
These terms apply to all users of our services, including students, prospective students, parents or guardians of minor students, and website visitors. We reserve the right to modify these terms at any time, and such modifications will be effective immediately upon posting on our website.
2. Course Enrollment and Registration
2.1 Eligibility
Students must be at least 16 years of age to enroll independently in our courses. Students under 18 must have written consent from a parent or legal guardian. We welcome students of all skill levels, from beginner to advanced, and offer placement testing to ensure appropriate course selection.
2.2 Registration Process
Course registration requires completion of our enrollment form, submission of required documents, payment of applicable fees, and acceptance of these terms. All information provided during registration must be accurate and complete. False or misleading information may result in enrollment cancellation.
2.3 Course Availability
Course schedules, availability, and curricula are subject to change based on enrollment numbers, instructor availability, and institutional requirements. We reserve the right to cancel courses with insufficient enrollment and will provide full refunds in such cases.
3. Payment Terms and Policies
3.1 Tuition and Fees
All tuition fees must be paid according to the schedule specified in your enrollment agreement. We accept various payment methods including bank transfer, credit card, and installment plans for qualified students. Late payment charges may apply for overdue accounts.
3.2 Refund Policy
Refunds are processed according to our published refund schedule. Full refunds are available if cancellation occurs more than 14 days before course commencement. Partial refunds may be available for early withdrawal, calculated based on completed course hours. No refunds are provided for courses completed beyond 50% of the total duration.
3.3 Financial Aid and Scholarships
Limited financial assistance may be available for qualified students. Scholarship recipients must maintain satisfactory academic progress and comply with program requirements. Failure to meet scholarship conditions may result in revocation and balance due.
4. Student Responsibilities and Conduct
4.1 Academic Integrity
Students are expected to maintain high standards of academic honesty. Plagiarism, cheating, or any form of academic dishonesty will result in disciplinary action, which may include course failure or program dismissal. All assignments and assessments must represent your own original work.
4.2 Attendance Requirements
Regular attendance is essential for academic success. Students must maintain at least 80% attendance to remain in good standing. Excessive absences may result in course failure or program dismissal. Make-up sessions may be available for excused absences, subject to instructor availability and additional fees.
4.3 Behavior and Respect
Students must treat all staff, instructors, and fellow students with respect and courtesy. Disruptive behavior, harassment, discrimination, or violence will not be tolerated and may result in immediate dismissal from the program without refund. We maintain a zero-tolerance policy for behavior that interferes with the learning environment.
5. Intellectual Property Rights
All course materials, curricula, teaching methods, and content provided by EnglishMY are protected by copyright and remain the intellectual property of our institution. Students may use materials for personal study purposes only and may not reproduce, distribute, or commercially exploit any materials without written permission.
Online course content, videos, and digital materials are provided for enrolled students' use only. Sharing login credentials or unauthorized distribution of course materials is strictly prohibited and may result in program termination and legal action.
6. Privacy and Data Protection
We are committed to protecting your personal information in accordance with Malaysia's Personal Data Protection Act and our Privacy Policy. By using our services, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy.
Student records and progress information will be maintained confidentially and shared only with authorized personnel, regulatory bodies when required, or third parties with your explicit consent. You have the right to access, correct, or request deletion of your personal data subject to legal and institutional requirements.
7. Technology and Online Services
7.1 Learning Management System
Students may be provided access to our online learning platform for course materials, assignments, and communication. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
7.2 Technical Requirements
Online and hybrid courses require reliable internet connection and compatible devices. Technical difficulties are not grounds for course extensions or refunds unless caused by institutional system failures. Students are responsible for ensuring they meet minimum technical requirements before enrollment.
8. Limitation of Liability
EnglishMY's liability is limited to the fees paid for the specific course or service. We are not liable for indirect, incidental, or consequential damages arising from your use of our services. This includes but is not limited to lost opportunities, career impacts, or third-party claims.
While we strive to provide high-quality education, we make no guarantees regarding specific learning outcomes, test scores, or career advancement. Student success depends on individual effort, attendance, and participation in the learning process.
9. Force Majeure
EnglishMY shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, government regulations, pandemics, labor strikes, or technological failures. In such cases, we will make reasonable efforts to continue providing services through alternative means.
10. Governing Law and Dispute Resolution
These Terms of Service are governed by the laws of Malaysia. Any disputes arising from these terms or your use of our services will be resolved through binding arbitration in Kuala Lumpur, Malaysia, in accordance with the Malaysian Arbitration Act.
Before initiating formal dispute resolution, parties agree to attempt good faith negotiations to resolve any disagreements. If arbitration is required, each party will bear their own costs unless otherwise determined by the arbitrator.
11. Modifications and Updates
EnglishMY reserves the right to modify these Terms of Service at any time. Changes will be posted on our website and will take effect immediately upon posting. Continued use of our services after changes have been posted constitutes acceptance of the modified terms.
Significant changes that materially affect student rights or obligations will be communicated via email to enrolled students. Students who do not agree to modified terms may withdraw from their courses subject to our standard refund policy.

13. Severability
If any provision of these Terms of Service is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.
